Terms & Conditions
These Terms & Conditions (“Terms”) govern access to and use of the website, mobile application, and services operated by Zooopp Wheels Private Limited (“Zooopp Wheels”, “Company”, “we”, “our”, or “us”). By accessing or using the platform, drivers, car owners, and customers (“Users”) agree to be legally bound by these Terms.
1. Nature of Services
Zooopp Wheels operates as a technology-enabled facilitation platform connecting customers, drivers, and car owners. The Company does not own vehicles unless expressly stated and does not act as an employer, insurer, or guarantor of any User.
All services are provided on a best-effort basis, subject to availability and compliance with these Terms.
2. Eligibility and Account Registration
Users must be legally competent to contract under Indian law. Drivers and car owners must provide accurate, complete, and up-to-date information, including identity documents, licenses, permits, and vehicle details, as applicable.
Zooopp Wheels reserves the right to verify information and to suspend or terminate accounts in case of misrepresentation or non-compliance.
3. Bookings, Payments, and Cancellations
All bookings are subject to acceptance and availability. Prices, charges, security deposits, and cancellation rules shall be displayed at the time of booking.
Refunds and cancellations shall be governed strictly by the Company’s Refund Policy, as published on the platform and incorporated by reference into these Terms.
4. Obligations of Drivers and Car Owners
Drivers and car owners agree to comply with all applicable laws, including motor vehicle laws, taxation rules, insurance requirements, and safety regulations.
Car owners are responsible for ensuring that vehicles listed are roadworthy, insured, and legally compliant. Drivers are responsible for holding valid licenses and complying with traffic laws at all times.
Zooopp Wheels shall not be responsible for violations committed by Users.
5. User Conduct
Users agree not to misuse the platform, engage in fraudulent activity, provide false information, damage property, harass other users, or use the platform for unlawful purposes.
Zooopp Wheels reserves the right to take corrective action, including suspension or termination, without prior notice in case of serious violations.
6. Limitation of Liability
Zooopp Wheels acts solely as a facilitator. The Company shall not be liable for accidents, damages, losses, delays, disputes, or third-party actions, except to the extent required under applicable law.
In no event shall the Company’s total liability exceed the platform service fees charged for the relevant transaction.
7. Intellectual Property
All content, trademarks, software, and platform materials are the exclusive property of Zooopp Wheels or its licensors. Unauthorized use, reproduction, or distribution is prohibited.
8. Termination
Zooopp Wheels may suspend or terminate access to the platform at its discretion for breach of these Terms, legal non-compliance, or security concerns. Termination shall not affect accrued rights or liabilities.
9. Governing Law and Jurisdiction
These Terms shall be governed by the laws of India. Courts having jurisdiction over the registered office of Zooopp Wheels Private Limited shall have exclusive jurisdiction.
10. Personal Data Collection
Zooopp Wheels collects personal data such as name, contact details, identity documents, vehicle information, location data, payment details, and usage data solely for lawful purposes connected with service delivery, verification, compliance, and platform security.
11. Consent and Lawful Use
By using the platform, Users provide free, specific, informed, unconditional, and unambiguous consent for the processing of personal data for stated purposes.
Personal data shall not be processed for purposes incompatible with those disclosed at the time of collection, unless required by law.
12. Data Principal Rights
Users (as Data Principals under the DPDP Act) have the right to:

13. Data Retention and Security

Zooopp Wheels implements reasonable technical and organizational safeguards to protect personal data against unauthorized access, loss, or misuse.
14. Data Sharing
Personal data may be shared with payment processors, verification partners, insurance partners, technology vendors, or government authorities strictly on a need-to-know basis and in compliance with the DPDP Act.

16. Amendments
Zooopp Wheels reserves the right to modify these Terms & DPDP provisions at any time. Continued use of the platform constitutes acceptance of the updated Terms.
